This action is based upon the complaint that the defendant company, through its agent, one L. E. Shueker, made a verbal contract with the plaintiff to cut and top all the merchantable juniper timber of the defendant in that part of the Dismal Swamp owned by the defendant, containing some 5,000 or more acres, at the rate of 6% cents per tree. The defendant denied that Shueker made such contract or that he had any authority to do so, and averred that the timber cut by the plaintiff was under a contract to cut the same, restricted to the service as performed from time to time, and…
