Appeal from a decree of the Circuit Court of Baltimore City (Dennis, J.), by which the Bagby & Rivers Co. were enjoined from using the name Rivers as part of its corporate title, and dismissing the cross-bill filed by that company against Arthur D. Rivers and the Rivers Furniture Company, asking that Rivers be enjoined from conducting the furniture business in Baltimore City, and that the Rivers Co. be enjoined from using that name.

This was a bill in equity, filed on the 22d of April, 1897, in the Circuit Court of Baltimore City, by the plaintiff, Arthur D. Rivers, for an injunction to enjoin the defendant, the Bagby and Rivers Company, of Baltimore City (a corporation), from using the name “Rivers” as a part of its corporate title. Subsequently, on the 13th of August, 1897, a cross-bill was filed by the defendant corporation against the plaintiff, Rivers and the Rivers Furniture Company, to restrain Rivers from conducting the furniture business in the city of Baltimore, either in his own name or in the name of the…
