OPINION

KOZINSKI, Chief Judge.

Plaintiffs seek a partial refund of fees paid to the Federal Grain Inspection Service for inspecting and weighing their grain from October 1977 to September 1981. The parties have stipulated the facts and cross-moved for summary judgment.

Facts

Plaintiffs operate high speed grain elevators through which they store and elevate *513grain destined for export. They are subject to the Grain Standards Act (the Standards Act), 7 U.S.C. §§ 71-87i (1982), and to regulation by the Federal Grain Inspection Service (FGIS), the agency charged with the Act’s administration.
