OPINION
LYDON, Judge.
This construction contract case comes before the court on motions for summary judgment, both parties claiming there are no material issues of fact in dispute and that they are entitled to judgment as a matter of law. On the other hand, each party opposes the summary judgment motion of the other party on the ground that the existence of genuine material issues of fact precludes the granting of said motion.
