PONDER, Justice.

The plaintiff seeks to recover from the Chicago, Rock Island and Pacific Railway Company, in bankruptcy, the sum of $42,-900 as damages for injuries he received on November 1, 1935 while operating a motorcar as a section foreman of the railroad company. It appears from the plaintiff’s petition that about one and a half miles above Reddell, Louisiana the tracks of the defendant company are crossed by a concrete paved highway.
