The statement of the case made below is substantially the same as made in appellees’ brief and is, we think, sufficient for the purpose of disposing of the issues presented on this appeal.
On November 10, 1915, Luther Eastham, Jr., filed his application for guardianship of the estate of his brother, W. A. Eastham, alleging that said brother was a person of unsound mind, and on the 30th day of November, 1915, and without a complaint in lunacy having first been filed against the said W. A.
