Appeal from a judgment of the County Court of Schenectady County (Catena, J.), rendered November 7, 2002, upon a verdict convicting defendant of the crimes of rape in the first degree and sexual abuse in the first degree.

Defendant was indicted for the crimes of rape in the first degree, sodomy in the first degree and sexual abuse in the first degree.
