Plaintiff below, appellant herein, General Factors, Inc., brought suit against defendants below, appellees herein, A. Deal Beck and A. Deal Beck Concrete Construction Company. The trial court entered *339judgment in favor of appellees and appeal was taken to the Supreme Court of Arizona. The matter was referred to the Court of Appeals of Arizona, Division 1, for determination.
