Appeal by plaintiff from an order denying Ms motion for a new trial after verdict for the defendant in an action to recover damages for personal injuries.

The accident occurred on the evening of August 9, 1935, on trunk highway No. 5 at a point approximately one-quarter mile west of Cedar avenue in Hennepin county, Minnesota. Plaintiff was injured while walking rapidly or running slowly, the evidence is not clear on this point, in a northwesterly direction across the pavement from the south side.
