This action was instituted by the Tuxedo State Bank against Roy E. Castetter, cashier of the named bank and London and Lancashire Indemnity Company of America, surety on Castetter’s bond running to the bank as obligee. After the filing of the complaint a receiver was appointed for the bank and he was substituted as plaintiff.
