Appeal from Tallapoosa Chancery Court. Heard before Hon. W. W. Whiteside. Bill by the Tallapoosa County Bank against W. W. Wynn, administrator, d. b. n. of F. A. Vaughan, the deceased cashier of said bank for an accounting and to fix and enforce a. lien upon the stock owned by his decedent, and upon a.deposit left by his decedent, and for other reasons. Decree for complainants and respondents appeal. No brief reached the Reporter.

Appellee filed this bill against the administratrix of the deceased cashier. Pending the suit she died, and the suit was revived and proceeded against appellant as administrator de bonis non.
The bill in the most general terms alleged that intestate was a stockholder, holding 140 shares of its stock; that for several months prior to his election as cashier, which occurred in the year 1895, he by some méans or contract with the former cashier, Wright, unknown to complainant bank, acted as its cashier — that is, during this time he was its cashier de facto but not de jure; *476that early in that…
