MEMORANDUM

DuBOIS, District Judge.

I. INTRODUCTION

Plaintiff Max Grosso filed this action against his employer, Federal Express Corporation (“FedEx”), alleging retaliation under the Family and Medical Leave Act (“FMLA”), 29 U.S.C. § 2615(a) (2); interference with his rights under the FMLA, 29 U.S.C. § 2615(a)(1); and retaliation under Section 510 of the Employee Retirement Income Security Program (“ERISA”), 29 U.S.C. § 1140.
