ORDER DENYING MOTION TO DISMISS

This Cause came before the Court upon the Motion to Dismiss, filed by the defendant on June 2, 1994, and amended on August 22, 1994. The motion alleges that the adversary proceeding was not filed within the statutory two-year limitations period. The debtor filed a Chapter 11 bankruptcy petition on April 28, 1992. This adversary proceeding was filed on April 28, 1994, two years later. A plain reading of Rule 9006(a), Fed.R.Bankr.Proe., indicates that the debtor-in-possession, against whom the limitations period is applicable,…
