THE COURT.

—This is an appeal from an order and judgment of the superior court of the county of Los Angeles admitting to probate the will of D. K. Smith, deceased.

The decedent at the time of his death, which occurred on February 28, 1925, was seventy-nine years of age. His widow, contestant and appellant, survived him but he left no issue. By a will bearing date February 23, 1925, the decedent devised and bequeathed his entire estate to the proponent and respondent, who was a friend of some years’ standing. On March 5, 1925, the proponent filed a petition for probate of said will and prayed…
