Action by appellee against appellant to recover damages on account of personal injuries sustained by reason of a defective sidewalk in the city of Huntington. The case was tried in the Wabash Circuit Court on change of venue. This is the second appeal. The former appeal is reported in 12 Ind. App. 133. The judgment of the lower court was reversed, because the complaint did not show that the appellant knew of the particular defect in the sidewalk through which appellee was injured, a sufficient length of time prior to the accident to have repaired the same in the exercise of reasonable care,…
