Upon the trial which resulted in the judgment now under review, the evidence upon which the plaintiff relies to establish negligence of the defendant, and upon which the latter relies to establish its countercharges as to plaintiff’s contributory negligence was substantially the same as on the first trial. In those respects the statement of facts in the decision reversing the former judgment (see 224 Wis. 347, 271 N. W. 380) is applicable on this appeal.
