HOLLAND, Justice:

The defendant-appellant, Edward C. Gibbs, was charged with Second Degree Rape Without Consent. 1 The Department of Probation and Parole filed a violation of probation report with the Superior Court based upon Gibbs’ arrest for that charged offense. Following a jury trial in the Su perior Court, Gibbs was acquitted of the charge. Gibbs was subsequently found to have violated his probation and was sentenced to be incarcerated for 6 years at Level V.
