BARRETT, Commissioner.

This essentially is a suit to construe two trust instruments executed by Harry E. Papin, Sr., one an insurance trust executed in 1930 and the other a “living trust” of securities executed in 1941. The trusts have terminated and construction is required to determine whether one of the appellants, Allen Ashley Papin, is entitled to one-half of the residuary sum, in excess of $315,000.00, now ready for distribution.
