ORDER DENYING MOTION TO COMPEL ARBITRATION
FOGEL, District Judge.
Plaintiff, Jonathan C. Kaltwasser (“Kalt-wasser”) brings this action against Cingu-lar Wireless, LLC (“Cingular”) for alleged violations of the California Business and Professions Code and the Consumer Legal Remedies Act (“CLRA”) and for breach of contract. Cingular moves to compel arbitration pursuant to the Federal Arbitration Act (“FAA”). The Court has considered the moving and responding papers and the argument of counsel presented at the hearing on January 25, 2008. For the reasons set forth below, the motion will be denied.
