This is an appeal from a judgment in favor of Elvin E. White, hereinafter called plaintiff, against D. W. Waddell, hereinafter called defendant, for the sum of $8,000. The undisputed facts leading up to the action, as they appear from the record, may he stated as follows:

The Arizona Citrus Land Company, hereinafter called the company, is an Arizona corporation which owns a considerable acreage of undeveloped land in the Beardsley project, situated west of the Agua Fría River.
