The plaintiff in error, hereafter called the Juniper Company, complains of a judgment against it in favor oLthe defendant in error,4 hereafter called the Nelson Company, and the controversy arises out of these facts:

The Juniper Company owned several tracts of standing timber in North Carolina, and was engaged in the business of manufacturing its timber into lumber. The Nelson Company was engaged in the business of selling lumber in the city of Baltimore, Md.
