In this special proceeding petitioner seeks (1) a compromise order pursuant to subdivision 5 of section 29 of the Workmen’s Compensation Law approving settlement of an action for conscious pain and wrongful death in which she, as administratrix of her husband’s estate, is plaintiff, and (2) an order fixing distribution of the proceeds of settlement pursuant to section 133 of the Decedent Estate Law.
