This is an appeal from an order of Supreme Court which approved a compromise settlement of a third-party negligence action pursuant to the provisions of subdivision 5 of section 29 of the Workmen’s Compensation Law.

The petitioner-respondent was injured on September 26, 1963 while riding as a passenger in an automobile owned and operated by Fred Jack, when it came into collision with an automobile owned and operated by James Montanye in the business of his employer, Rubin Glass & Mirror Co., Inc.
