Plaintiff’s husband was killed in a right-angle collision with defendant’s train at a grade crossing, and in her action for damages she recovered $8,000, on which judgment was entered. The tracks of the railroad, at the point of collision, are elevated above the level of the public road some three or four feet and the grade on each side of the railroad crossing is about eight per cent.
