Rao, Judge:

This civil action is before the Court on plaintiffs motion pursuant to Rule 41(a)(2) of the Rules of the Court of International Trade for an order of voluntary dismissal with prejudice. The defendants have filed a cross motion for attorneys fees, costs and expenses.

It is defendants’ position that the action was brought in bad faith, recklessly, wantonly or for oppressive reasons.
