STEELMAN, Judge.

Respondents, the North Carolina Department of Environment and Natural Resources, Division of Coastal Management (DCM) and the North Carolina Coastal Resources Commission (CRC), appeal a trial court order granting attorney’s fees and costs to petitioners, Sammie E. Williams and Williams Seafood, Inc. For the reasons discussed herein, we reverse.
