MEMORANDUM
JULIAN, Chief Judge.
This case is before the court on plaintiffs’ motion for summary judgment and defendants’ and defendant-intervenors’ motions to dismiss the complaint for failure to state a claim upon which relief can be granted. On March 2, 1971, this Court denied plaintiffs’ application for a preliminary injunction in a memorandum of decision reported in Druker v. Sullivan, 322 F.Supp. 1126 (D.Mass. 1971). Having now exhausted administrative remedies before the Boston Rent Board, plaintiffs move, pursuant to Fed.R.Civ.P. 56, for summary judgment on the record as presently…
