Appeal by defendant from a judgment of the Supreme Court, Kings County (Lagaña, J.), rendered July 20, 1981, convicting him of assault in the first degree and endangering the welfare of a child, after a nonjury trial, and imposing sentence. By order dated November 29, 1982, this court remitted the case to Criminal Term to hear and report on the question of whether defendant formally waived his right to a jury trial in accordance with NY Constitution, article I, § 2 and held the appeal in abeyance in the interim (People v Basora, 90 AD2d 851). Criminal Term (Heller, J.), has now complied.
