MEMORANDUM AND ORDER
HAIGHT, Senior District Judge.
By notice filed on November 10, 2003 pursuant to 28 U.S.C. § 1441, defendant removed this case from a New York state court, claiming diversity of citizenship under § 1332(a)(1) as the source of federal subject matter jurisdiction. At the first hearing before this Court on November 13, counsel for plaintiff made a speaking motion to remand the case to the state court for lack of the requisite jurisdictional amount.
