DUFFY, District Judge.
This matter is before the court upon Plaintiff 1 Jason Besse’s (“Besse”) Motion to Remand. For the reasons set forth herein, Plaintiffs motion is granted.
BACKGROUND
On January 29, 2004, Plaintiff filed this purported class, action in the Court of Common Pleas for Dorchester County, South Carolina on behalf of himself and all others similarly situated.
