Appeal from a judgment of the County Court of Chemung County (Danaher *961Jr., J.), rendered May 17, 1989, upon a verdict convicting defendant of the crime of grand larceny in the fourth degree.
On November 26, 1988, defendant entered Cathy’s Auto Sales in the City of Elmira, Chemung County, and asked to test drive a 1979 Oldsmobile. After a brief discussion with the owner, Cathy Kent, defendant was given $5 for gas, the keys and dealer plates to take the car for a ride, and was informed that he should not be gone long as the business would soon close.
