Appeal from a judgment of the County Court of Ulster County (Vogt, J.), rendered April 5, 1984, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the fifth degree.

On May 24, 1983, at about 8:00 p.m., defendant, who was taking a short cut across the State University campus at New Paltz, encountered two women walking near several dormitories. Defendant requested and received a cigarette from one of them.
