Daniel Fitzpatrick brought this action in the district court for Sheridan county against the Chicago, Burlington & Quincy Railroad Company, under the provisions of the federal employers’ liability act of April 22, 1908, to recover damages for personal injuries claimed to have been sustained by him on account of the negligence of the defendant. Later Walker D. Hines, director general of railroads under United States railroad administration, was substituted as party defendant.
