HAMITER, Justice.

Tom C. Pearson, in this action, seeks •to' recover disability benefits of $50 per •month from April 6, 1944, together with statutory penalties' and. attorney’s fees, allegedly due under a policy issued to him by defendant, the Prudential Insurance Company of America.

Finding that plaintiff was totally and •presumably permanently disabled, as defined in the contract of insurance, the district court rendered judgment in his favor for all monthly benefits accruing on and after April 6, 1944, and also for the premiums paid during that period.
