MEMORANDUM OPINION

BEATY, District Judge.

This case involves an action by Plaintiff Carla H. Harvey (“Plaintiff’ or “Ms. Harvey”) to recover disability benefits under a long-term disability policy issued by Defendant Unum Life Insurance Company of American (“Unum”). This action is governed by the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001, et seq. (“ERISA”).
