GOODRICH, Circuit Judge.

This case involves the application of the rules of res judicata to a civil suit brought by the plaintiff, through its trustee in bankruptcy, for injuries alleged to have been sustained because of the defendant’s violation of the anti-trust laws.

This action, which we shall call action No. 1, was begun on February 14, 1938. It charged that the defendant, conspiring with certain other persons, had, in violation of the provisions of the anti-trust laws, 1 inflicted great injury upon the plaintiff.
