ORDER GRANTING AND DENYING MOTIONS FOR SUMMARY JUDGMENT

WINDER, Chief Judge.

This matter is before the court on a motion for summary judgment filed by Plaintiff Liane B. Foutz (“Foutz”) and a cross-motion for summary judgment filed by Defendant United States of America (“United States”). A hearing on both motions was held on June 1, 1994. At the hearing, Barrie G. McKay represented Foutz and Kirk C. Lusty represented the United States.
