I. Introduction

Plaintiff, Skinder-Strauss Associates (“Skinder-Strauss”) brings this action against Defendant, Massachusetts Continuing Legal Education, Inc. (“MCLE”) for copyright infringement and unfair and deceptive trade practices arising out of the publication of competing legal directories. 1 Specifically, Skinder-Strauss alleges that MCLE’s 1994 Massachusetts Legal Directory unlawfully copied protected material from its 1993 Massachusetts Lawyers Diary and Manual.
