MEMORANDUM OPINION AND ORDER
GOODWIN, District Judge.
The defendant in the above-styled case has filed a motion to dismiss/motion for summary judgment. Essentially, the defendant argues that West Virginia does, not, and should not, recognize the plaintiffs’ claim for “wrongful adoption.” Alternatively, the defendant argues that even if the plaintiffs have stated an actionable claim, it is barred by the statute of limitations. For reasons discussed herein, the defendant’s motion to dismiss/motion for summary judgment is DENIED.
