MEMORANDUM AND ORDER

This is a property damage case. This complaint asserts three distinct theories of recovery; negligence, Strict liability in tort, and breach of warranty. Jurisdiction is predicated on diversity of citizenship. The facts are simply stated. On December 5, 1975, plaintiffs purchased a new refrigerator which was manufactured by the defendant. It is alleged that on February 27,1978 the refrigerator suddenly caught fire, resulting in the destruction of the plaintiffs’ residence and extensive loss of personal property. No loss of life or…
