The parties in this case dispute the validity of the plaintiffs attempt to accept the defendant’s settlement offer under chapter 42 of the Civil Practice & Remedies Code and rule 167 of the Texas Rules of Civil Procedure. We' hold that the plaintiff presented uncontroverted evidence that it accepted the material terms of the defendant’s offer. We therefore reverse the court of appeals’ judgment and remand for that court to consider the defendant’s remaining challenges to the trial court’s summary judgment in favor of the plaintiff.
