The petitioner was the plaintiff in a suit filed against Arkansas Power and Light Company (AP&L) and others in the chancery court. That suit alleged illegality of a settlement, entered into among the defendants, having to do with AP&L’s liability for a portion of expenses of building the Grand Gulf power generator. In response to a motion to dismiss the suit, the chancellor entered an order on October 15,1985, recognizing the exclusive jurisdiction of the Arkansas Public Service Commission (A.P.S.C.) in utility rate cases but refusing to dismiss the petitioner’s suit until the court was…
