BERRY, Justice.

On November 8, 1955, the Corporation Commission, hereafter referred to as “Commission” promulgated an order (No. 31,025) embracing that portion of Cherokee and Grant Counties, Oklahoma, from which it was then believed that oil and gas would be produced from the Cherokee Sand. By said order 40-acre drilling and spacing units for the production of oil or gas were provided for.
