The plaintiff in error, hereinafter called defendant, was convicted in the district court of Coal county of rape in the first degree and his punishment fixed at death. The information was filed September 14, 1932, on which date defendant was arraigned in the district court, entered a plea of guilty, and was sentenced to death. Prom this judgment appeal was taken to this court and the judgment was reversed. 54 Okla. Cr. 207, 16 Pac. (2d) 886. Defendant then entered a plea of not guilty and trial had, which resulted in the judgment from which this appeal is taken.
