Appellant, Lawrence Mitchell, was indicted, charged with the murder of James Williams. Upon a trial had, the jury found Lawrence Mitchell guilty of murder and fixed his punishment at death. Motion for new trial was duly filed and overruled, and in pursuance of the verdict of the jury he was sentenced to suffer death by electrocution as provided by law. The plaintiff in error in this opinion will be referred to as the defendant.
