dissents, and votes to reverse the judgment and grant that branch of the defendant’s omnibus motion which was to suppress his statements to law enforcement officials: I respectfully dissent from the majority’s determination, first, because I find that the defendant did not validly waive his right to appeal. *751Additionally, in my view, the defendant did not knowingly, intelligently, and voluntarily waive his right to seek appellate review of the hearing court’s suppression ruling.
