The plaintiff has applied for an order directing the filing with the clerk of Westchester County, nuno pro tuna, of a confession of judgment executed by the defendant which was filed with the clerk of New York County on September 16, 1926.
The defendant has appeared specially to challenge the jurisdiction of the court but it has been stipulated that he may also oppose the motion on the merits without waiving the legal effect of his special appearance.
These motions have their origin in an action which the plaintiff had instituted against the defendant in this court in 1925. The action was…
