Appeal by the defendant, Federal Trust Company, from two orders of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 2d day of November, 1916, the first granting plaintiff’s motion to file a certain notice nunc pro tunc as of August 30, 1914, and the other denying defendant’s motion to vacate the warrant of attachment herein.

These two appeals may conveniently be considered together. The defendant is a foreign corporation, and the action was begun on August 5, 1914, by the issuance of a warrant of attachment. On August 31, 1914, an attempt was made, pursuant to an order for publication, to serve the defendant personally without the State, and on that date copies of the summons, complaint, order of publication and the affidavits upon which it was granted were personally served upon an officer of defendant within the State of New Jersey.
