JOHNSON, Circuit Judge:

This appeal presents this Court with an opportunity to examine the issues involved in the evaluation of claims of race and sex discrimination in the selection of federal grand jury forepersons by United States District Judges. The government invites us to accept the district court’s conclusion in this case that the office of federal grand jury foreperson is constitutionally insignificant and therefore that allegations of discrimination in the selection of forepersons cannot form the basis for a motion to dismiss a criminal indictment.
