Plaintiff instituted the present action against the defendant seeking to recover damages for personal injury in the sum of $50,000. It appears from the complaint that plaintiff was in the employ of defendant at its packing plant in Sioux Falls, and while engaged in the usual course of his employment suffered a personal injury by accident arising out of and in the course of said employment.
